The City of Casey is committed to protecting an individual’s right to privacy and the responsible and fair handling of personal information. This commitment is supported by the new laws dealing with personal information that may be collected by the Council in undertaking its statutory functions and other activities.

Casey Connect Privacy Policy

The City of Casey (“Casey”) is bound by the Information Privacy Act 2000 (Vic) (“Privacy Act”) and the Information Privacy Principles (“IPPs”) made under the Privacy Act.  To the extent the “Casey Connect” service (“service”) provided by Casey via the website located at www.caseyconnect.net.au (“website”) involves the collection, use and disclosure of personal information protected under the Privacy Act, Casey has implemented this privacy policy to explain how Casey handles personal information relating to individuals provided to Casey in the course of using the website and the service.

Purpose of Information Collection

Casey collects personal information about individuals to the extent that such collection is necessary for one or more of the following reasons:

  1. the information is required in connection with their use of the website and the service;
  2. the information is required in connection with the maintenance of community groups via the website and the service;
  3. the information is required by Casey in order to assess the market for Casey’s services; and
  4. the information is required to comply with any of Casey’s legal obligations or is required in connection with any legal proceeding involving Casey whether in relation to the individual to whom the information relates or otherwise. 

Types of information collected

Casey collects the following types of information for any of the purposes outlined above (without limitation):

  1. An individual’s name, address, telephone number, facsimile number, email address, age, date of birth;
  2. User identification and passwords required in connection with that individual’s use of the website, including privacy questions;
  3. All of the same details as may be available in relation to the organisation or group that the individual represents or is acting in connection with including material relating to the nature and composition of the organisation or group.  

Means of collection

Casey will collect personal information lawfully and fairly in a number of ways, including:

  1.  Directly from the individual via an application form or correspondence or in response to a request from Casey;
  2. From third parties, including contracted service providers, community groups, or the individual’s authorised representatives or legal advisers; and
  3. from publicly available sources of information. 

As far as it is practicable to do so, Casey will collect personal information about an individual directly from that individual.   Casey will inform the individual of the purposes for which the information is collected, and how the individual may access the information.

Effect of non-provision of Information

If the information Casey requests is not provided to Casey, Casey may not provide the services to the individual requesting those services.

Information Use and Disclosure

By using the service and website, an individual will be deemed to have consented to Casey using that individual’s personal information collected by Casey for the following purposes:

  1. communicating with any necessary party in order to effect an agreement, or in connection with an agreement, entered into by that individual with Casey;
  2. for the processing of any financial matters necessary in connection with Casey’s provision of services;
  3. communicating information through Casey’s internet service provider that may from time to time be engaged by Casey at its sole discretion;
  4. to Casey’s contracted service providers who manage the services provided by Casey;
  5. where appropriate under another Act of Parliament, including the Freedom of Information Act 1982;
  6. in public registers that need to be maintained in accordance with other Acts, as a release of information relevant for the purpose for which the registers exist;
  7. to an individual’s authorised representatives or legal advisers;
  8. to Casey’s professional advisers, including accountants, auditors and lawyers;
  9. to organisations assisting Casey to perform statistical analyses for improving services delivered to the community, provided that, where reasonable and practicable, Casey will take steps to de-identify the information; and
  10. to government agencies and other organisations, with the individual’s specific consent, or where required or authorised by law, which may include emergency situations and assisting law enforcement agencies.

Casey will not use or disclose personal information that Casey collects from an individual for any secondary purpose other than the primary purpose outlined above without an individual’s consent unless:

  1. the secondary purpose is related to the primary purpose and an individual would reasonably expect Casey to use or disclose the information for that secondary purpose.
  2. In the case of direct marketing not related to Casey’s activities, Casey has obtained the individual’s prior consent (unless it is not reasonably practicable to seek the individual’s consent and Casey otherwise complies with the requirements of the Privacy Act); or
  3. The use or disclosure is otherwise permitted under the Privacy Act. 

Data Security and Quality

Casey will take reasonable steps to protect the personal information which Casey collects via the “Casey Connect” service and website from misuse or loss and from unauthorised access, modification or disclosure.

Although Casey strives to protect an individual’s personal information, no data transmission over the internet can be guaranteed to be secure.   Therefore, Casey does not warrant the security of any information that Casey transmits to an individual, that an individual transmits to this website or that Casey or the individual transmit in connection with the use of this website. By using this website, an individual accepts this risk.

All personal information will be removed from Casey’s systems, if it is no longer needed for any purpose, except where it needs to be retained in accordance with any applicable law.

Currency of Privacy Policy

From time to time, Casey may amend this Privacy Policy and any amendments will be published on this website.   An individual may obtain a copy of the current Privacy Policy from this website or by contacting Casey via the details below.

Access, Correction and Further Information

Individuals may contact relevant Casey staff (including Casey’s Privacy Officer) to access their personal information collected via this website, unless Casey is permitted under the Privacy Act to refuse to provide that individual with such access.

Casey may charge an access fee for recovering the costs of retrieving the required personal information.

If an individual establishes that the personal information is inaccurate, incomplete or out-of-date, Casey will take reasonable steps to correct such personal information.

Identifiers and Anonymity

Casey will not adopt as its own identifier, an identifier that has been assigned by another government agency.   Casey will not use or disclose the identifier assigned to an individual by another government agency, unless the individual’s consent has been obtained or Casey is required by law to do so.

Whenever it is lawful and practicable, individuals may exercise the option of not identifying themselves when supplying information or entering into transactions with Casey.

Transborder Data Flows

To the extent Casey collects personal information about an individual and such personal information is transferred outside Victoria to any party that is not Casey or the individual, Casey transfers such personal information to the recipient of the information who Casey reasonably believes is subject to a contract which effectively upholds principles for fair handling of the information transferred that are substantially similar to the Information Privacy Principles made under the Privacy Act as the context requires.
